All Homeowners:
The Board is in the process of developing design standards for the installation of solar panels on homes in the Sycamore community and would like the feedback of homeowners in this process.
Article 4.15 of the Sycamore CC&R's states that "No solar panels may be mounted, installed or maintained on the roof of any Residence so as to be Visible from Neighboring Property without the prior written approval of the Design Review Committee".
However, Arizona Revised Statute 33-1816 states that "Notwithstanding any provision in the community documents, an association shall not prohibit the installation or use of a solar energy device as defined in section 44-1761. An association may adopt reasonable rules regarding the placement of a solar energy device if those rules do not prevent the installation, impair the functioning of the device or restrict its use or adversely affect the cost or efficiency of the device".
We wish to adopt design guidelines compatible with our CC&R's and the Arizona Revised Statute. We currently have one request for the installation of solar panels from Sam Moeller, Lot 7. Please see the attached proposed Design Plan. Please note that the proposed design includes solar panels that will be visible from neighboring properties.
We would like homeowner comments on the following:
- Are you in favor or opposed to solar panels that are on front-facing roofs that are Visible from Neighboring Properties?
- Are you in favor or opposed to solar panels that are on side-facing roofs that are Visible from Neighboring Properties?
- Any other comments with respect to the installation of solar panels?
We would appreciate comments by no later than December 7, 2022 as our intent is to formulate guidelines at our next scheduled Board Meeting on December 8, 2022. Please send all comments to Chris Knudsen, our property manager, at chris@heywoodmanagement.com.
